These Terms and Conditions form a client agreement between ‘You’ and ‘Your’, the client, visitor, or website user and Coastal Midwifery and Lactation (CMAL), ABN 57 589 123 223 also referred to as ‘Amy Cameron’, ‘We’, ‘Us’, ‘Our’.
The information contained in this website is for general information purposes only. You need to make your own enquiries to determine if the information or products are appropriate for your intended use.
AMENDMENT OF TERMS
We reserve the right to change, modify, add or remove portions of these terms at any time. Please check these terms regularly prior to using our website to ensure you are aware of any changes. We will endeavour to highlight any significant or substantive changes to you where possible. If you choose to use our website then we will regard that use as conclusive evidence of your agreement and acceptance that these terms govern your and CMAL and obligations to each other.
COMPETITION AND CONSUMER ACT
You must be over 18 years of age to use this website and to purchase any goods or services.
For the purposes of Schedule 2 of the Australian Consumer Law, in particular Sections 51 to 53, 64 and 64A of Part 3-2, Division 1, Subdivision A of the Competition and Consumer Act 2010, CMAL liability for any breach of a term of this agreement is limited to: the supplying of the goods or services to you again; the replacement of the goods; or the payment of the cost of having the goods or services supplied to you again.

BOOKINGS
Our fee schedule is as per website displayed on the ‘Services’ page. By making a booking with CMAL, you are accepting these Terms and Conditions and Fees listed in Services page.
All clients with bookings will receive an appointment reminder via email or mobile text message, 36 hours before their appointment time. In cases where confirmation has not been received, CMAL will reasonably endeavour to contact you to confirm your appointment and obtain pre-appointment documentation.
All consultations require a $50.00 booking deposit to secure the appointment time. The Booking deposit is non-refundable if you cancel your appointment within 24 hours of your appointment time.
By booking your appointment you are accepting CMAL cancellation policy and Fee Schedule as outlined in these Terms and Conditions.
FEE SCHEDULE AND PAYMENT
Please read the information about fees and charges the ‘Services’ page as per website prior to booking. All bookings are made via Cliniko Software and all bookings incur a late cancellation fee. Payment for services can be made via cash or bank transfer, banking details are provided on invoice emailed before consultation.
Travel Charges – All in home consultations booked that require travel in excess of a 30 minutes one-way attract an additional travel fee of $1.00 per KM x 2 (return) or as negotiated by yourself and CMAL.
Distance is determined from COWES, Victoria 3922. All travel that falls within 30 minutes from this location is included in the service fee and no additional travel fees are charged.
CANCELLATION POLICY
24 hours’ notice is required to cancel or reschedule your appointment. If you cancel your booking within less than 24 hours, a $50.00 late cancellation fee will apply OR if you have paid the deposits - this will be held by CMAL. Repeated late cancellations will require a full payment to be received before attending a rescheduled appointment. New appointment times are subject to availability.
If your appointment is cancelled by CMAL within 24 hours of your appointment time, no financial penalty will be incurred by you. If in the event your appointment is cancelled by CMAL and a deposit has been received, and no suitable replacement appointment can be arranged in a reasonable timeframe, your full deposit will be refunded.
NO SHOW POLICY
A ‘No Show’ occurs in the event that CMAL arrives at the designated appointment address at the appointment time and you are not there within 15 minutes of the appointment commencing.
In the event of a ‘no show’ all reasonable attempts will be made by CMAL to contact you and make an alternative appointment. If an alternative appointment is not made within 48 hours of the appointment time, 100% of the appointment fee plus any travel costs as outlined in these Terms and Conditions will be invoiced to you and payable within 7 days.
DELIVERY OF SERVICES & GOODS
CMAL business hours are Monday to Friday 8am – 4pm unless otherwise specified. Due to the nature of health care and urgency of client support, contact with CMAL may be undertaken outside these hours. This is not guaranteed and dependent on other commitments. CMAL will attempt to reply to your messages/emails/calls within 24 hours.
In an urgent or emergency situation, please do not contact CMAL for advice or health care - please contact 000.
CMAL does not have an ongoing responsibility for urgent or emergency health care.
Physical goods are delivered by Australia Post. Deliveries are processed promptly upon receipt of full payment. Delivery may take between 2 and 14 days, depending on the delivery option. Damaged or lost orders should be resolved with Australia Post directly and CMAL is not responsible for goods that are damaged or lost in transit or not received.
PRIVATE HEALTH FUNDS
If you have private health insurance, you are responsible for liaising directly with your private health fund to determine if you are eligible for private health benefits in respect of the services provided from CMAL.
DISPUTE RESOLUTION PROCESS
CMAL is are committed client satisfaction. In the event you are unhappy with the Services provided by Amy Cameron or CMAL, you are encourage to contact to discuss and rectify if appropriate.

For midwifery, the Australian Health Practitioner Regulation Agency is the governing agency; information regarding concerns and process for complaints can be found at https://www.ahpra.gov.au/

CMAL may be required, in certain circumstances, to disclose information in good faith and in the following circumstances: by law or by any court; to enforce the terms of any of our customer agreements; or to protect the rights, property or safety of our customers or third parties.
JURISDICTION
This agreement and this website are subject to the laws of Victoria and Australia. If there is a dispute, that results in litigation then you must submit to the jurisdiction of the courts of Victoria.
PRIVACY
CMAL is committed to protecting your privacy. We use the information we collect about you to maximise the services that we provide to you. CMAL respects the privacy and confidentiality of the information provided by you and adheres to the Australian Privacy Principles.
You may change your details at any time by advising us in writing via email. All information we receive from our customers, is protected by our secure servers. All customer data collected is secured against unauthorized use or access. Credit card information is not stored by us on our servers.
